How we approach HOA claims
An introduction to investigating a shared building problem and helping a board understand the path toward repair.

Okay, so generally, what happens with an HOA is that some of the members, they've noticed that something's off with the construction of their community. Sometimes it's the building envelope, which means the exterior of the building, it could be a foundation issue, retaining wall, a bunch of different things. And then they have the community has a decision to make. Either they can make an assessment on the owners, in which to fix it, or they can get the building contractor or the developer to pay to fix it.
And almost invariably, the homeowners decide that they want who caused the problem to pay for it, because the building owners didn't pay for that. They paid for a, you know, kind of a nice, um, functional home and functional community, they didn't pay for a maintenance disaster. And so, and then they come to us. And what we do is we send out our team of experts to determine, one, what's the nature of the problem?
Two, what needs to get done to fix it, and three, how much it's gonna cost to fix it. And then what we do is for the 4th step, and this is where really kind of our approach is different, is then we use our multidisciplinary team, including our former, uh, insurance adjuster, um, including our construction, former, construction superintendent, and everybody else on our team to really map out the interests at the construction company, at the developer, at the, um, insurance company, including all the individual insurance adjusters, through all the different authority levels at the litigation claims department, and really understand what their incentives are. And then, what we do is we work to resolve the claim. There's a bunch of different ways we do that, but anyhow, through this process, usually we're able to get very satisfactory results for our community association clients in which they're able to fix their community in a way that's very appealing to the homeowners and really minimize the amount of drama for the board as well.
